📜 Digiwash Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") govern access to and use of the Digiwash digital platform, including the mobile application, website, and related services (collectively, the "Platform"). By accessing or using the Platform, users and partners agree to be bound by these Terms.

2. Definitions

· Digiwash means the Digiwash digital platform and its operators.

· Customer means any individual or entity booking car wash services through the Platform.

· Partner means an approved car wash service provider listed on the Platform.

· Services means car wash and related services offered by Partners via the Platform.

3. Platform Role

Digiwash operates as a technology-enabled marketplace connecting Customers to independent Partners. Digiwash does not itself provide car wash services and is not responsible for the physical execution of services.

4. User Eligibility

Users must be at least 18 years old and capable of entering into legally binding contracts to use the Platform.

5. Account Registration

· Users must provide accurate and complete information during registration.

· Digiwash reserves the right to suspend or terminate accounts with false or misleading information.

6. Bookings & Payments

· All bookings must be made through the Platform.

· Prices displayed are inclusive of applicable charges unless stated otherwise.

· Payments shall be made through Digiwash-approved digital payment channels.

7. Partner Obligations

Partners shall:

· Provide services in accordance with Digiwash quality and safety standards

· Maintain valid licenses, permits, and insurance where applicable

· Handle customer vehicles with reasonable care and professionalism 

8. Customer Obligations

Customers shall:

· Provide accurate vehicle and service details

· Remove personal valuables from vehicles

· Inspect vehicles upon service completion

9. Cancellations & Refunds

· Cancellation timelines and applicable fees shall be communicated on the Platform.

· Refunds, where applicable, shall be processed through original payment channels.

10. Ratings & Reviews

Customers may provide ratings and reviews based on genuine experiences. Digiwash reserves the right to remove abusive, false, or misleading content.

11. Liability Limitation

To the maximum extent permitted by law:

· Digiwash shall not be liable for acts or omissions of Partners

· Digiwash is not liable for indirect or consequential losses

12. Indemnity

Users and Partners agree to indemnify Digiwash against claims arising from misuse of the Platform, breach of these Terms, or regulatory violations.

13. Suspension & Termination

Digiwash may suspend or terminate access for:

· Breach of these Terms

· Fraudulent or unlawful activity

· Reputational or operational risk

14. Data Protection & Privacy

Personal data shall be processed in accordance with Digiwash Privacy Policy and applicable data protection laws.

15. Intellectual Property

All Platform content, trademarks, and systems remain the property of Digiwash and may not be used without consent.

16. Amendments

Digiwash may amend these Terms from time to time. Continued use of the Platform constitutes acceptance of revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya.

18. Dispute Resolution

Disputes shall be resolved amicably, failing which they shall be referred to arbitration or courts of competent jurisdiction in Kenya.
